Business Litigation
Jansen Law Firm, PLLC is routinely asked to handle business disputes for individuals, small businesses, and Fortune 500 companies. We have successfully tried or settled a variety of business disputes involving contracts, deceptive trade practices, fraud, fiduciary duties, partnerships, shareholders, tortious interference, unfair competition, defamation, and business disparagement.
Businesses and their representatives are expected to behave lawfully in their practices and dealings. Business persons and their clients have a right to expect contracts to be honored and competition among businesses to be conducted fairly. A party’s failure to meet this expectation, though, can cause significant damages. At Jansen Law Firm, PLLC, our business dispute attorneys provide professionals in the Austin, Houston, Dallas and San Antonio, Texas areas with legal representation. We have helped a number of local and national businesses reach fair resolutions to their disputes.
Our firm accepts business dispute cases involving a variety of disagreements, including:
Breach of Contract If one or more parties involved in a contractual agreement fail to hold up their contractual obligations, a breach of contract is said to have occurred. This term may apply whenever a party fails to carry out its obligations within the designated period of time, impedes the other party’s ability to perform its duties, or fails to perform its duties entirely.
Unfair Competition and Anti-Competitive Behavior This type of business dispute involves cases of trademark infringement, false advertising, use of confidential information to solicit customers, trade secret misappropriation, libel, “bait and switch” (in which customers are lured in by one bargain-priced item but are then encouraged to buy another similar but more costly item), and antitrust violations. In a notable business dispute case, our attorneys recovered damages for a Swedish company that had suffered a loss in profits after a competitor made defamatory statements about the quality of the company’s work.
Intellectual Property Disputes Our business dispute attorneys can help arbitrate cases involving intellectual property infringement, including those that pertain to the protection of copyrighted books, art, software, design, trademarks, and other protected property.
Partnership and Shareholder Disputes This type of business dispute often involves disagreements over financial matters such as the share of a company’s profits to which each party is entitled or the allocation of assets after a company breaks up.
Restrictive Covenants Employers and other entities often establish restrictive covenants in order to protect themselves from competition from former employees or business partners and to prevent the exploitation of confidential information and trade secrets. When a former employee, partner, or other party violates the terms of a restrictive covenant, a business can sustain serious losses. Our business dispute attorneys have helped numerous businesses in Austin, San Antonio, and other areas of Texas resolve disputes over restrictive covenant terms and violations.
